Moral and Ethical Considerations in Crisis Standards of Care

Ethics are a set of guides of conduct handed down to us over centuries but are they situational? Do ethics change in a disaster? Are there deeper issues that arise in resource austere environments? Perhaps more importantly are there steps we can take now to "ethics proof" our disaster response?
There are some givens, one is when the event is over critics will replace volunteers and for those systems which adopted the Outback approach of No Rules Just Right may find themselves wishing there had been more planning and more collaboration. This session will review recent ethical concerns emanating from Haiti and elsewhere and suggest steps to move closer to ethics proofing your organization.

Legal Issues to Consider in Developing Crisis Standards of Care

  • Tort liability is not a problem in disaster response
  • Federal and state regulatory flexibility is necessary and does require standards modifications
  • Federal and state disaster plans under estimate risk and over promise response, creating unrealistic public expectations
  • Unrealistic public expectations create real legal and moral hazards

Hurricane Katrina represented an unprecedented disaster of cataclysmic proportions. Local, state and federal resources were ill-prepared and overwhelmed, as were hospital systems. During disasters, resources (hospital and other) may be overwhelmed and/or limited. When this occurs, rules of daily clinical practice do not always apply.  The catastrophic events surrounding Hurricane Katrina highlighted the need for widely accepted medical guidelines for altered standards of care, in particular for allocation of resources,   widely accepted triage protocols for mass casualty events in the United States and the need for legal protection for those health care providers rendering care under extreme circumstances.

During her presentation, Dr. Anna Pou will help  the audience:

  1. Become familiar with disaster  triage and associated ethical issues
  2. Understand the need for medical and ethical guidelines to be used during disasters/mass casualty events
  3. Understand the legal risks and strategies for legal protection of healthcare providers during disasters
  4. Understand the the model legislation passed in Louisiana regarding disaster medicine reform
